Telephone Consumer Protection Act of 1991 (TCPA), Pub. L. No. 102-243, codified at 47 U.S.C. §227 (1991) (full-text).


The Act, inter alia, prohibits the use of autodialers or prerecorded voice messages to call cellular phones, pagers, or other services for which the person would be charged for the call, unless the person has given prior consent. In 2003, the FCC ruled that TCPA applies to any call that uses an automatic dialing system or artificial or recorded message to a wireless phone number, including both voice messages and text messages, such as Short Message Service (SMS).[1]
