A statement is defined as
“ | (1) an oral or written assertion, or (2) nonverbal conduct of a person, if it is intended by that person as an assertion.[1] | ” |
The critical question in that regard is often whether the record is computer-generated (likely not a statement) or computer-stored (may include statements).
