Specific performance is an alternative remedy to the award of money damages for a breach of contract. It is designed to produce the same effect that performance of the contract would have produced. It consists of a court ordering the breaching party to perform as promised. Specific performance will be ordered only if there is no adequate monetary remedy.
Uniform Commercial Code[]
Under Sections 2-716(1) & (2) of the Uniform Commercial Code (U.C.C.):
“ | (1) Specific performance may be decreed where the goods are unique or in other proper circumstances.
(2) The decree for specific performance may include such terms and conditions as to payment of the price, damages, or other relief as the court may deem just. |
