Factual Background[]

The defendants were distributing copyrighted Playboy images on its website. Playboy sued them for copyright infringement.

Trial Court Proceedings[]

The court found for Playboy and allowed Playboy to recover statutory damages for each of the 7,500 images infringed, rather than awarding damages on a per magazine basis. The judgment was for $3.74 million plus costs and attorney's fees.
