Definitions[]

General[]

Ownership is the bundle of rights allowing one to use, manage, and enjoy property, including the right to convey it to others. Ownership implies the right to possess a thing, regardless of any actual or constructive control. Ownership rights are general, permanent, and heritable.[1]

Patents[]

As stated in Israel Bio-Engineering Project v. Amgen Inc., 475 F.3d 1256, 1265 (Fed. Cir. 2007) (full-text):

[t]he contract . . . gives IBEP exclusive ownership over the patent because this agreement gives it the right to an assignment of "all rights, title and interest" to "all inventions resulting from the R & D Programs."
