Factual Background[]

The lessee was having difficulty with its computer system. The equipment was supplied by Odyssey Systems, who later assigned its rights under the lease agreement to the plaintiff.

The defendant refused to pay the plaintiff because the system was not performing properly.

Trial Court Proceedings[]

The court found that, since the defendant had accepted the computer equipment, it could not assert any claims against the plaintiff-assignee, but must assert any claims it has against the original lessor of the equipment.[1]
