Overview[]

The Act came into force in the United States on March 1, 1989, making it a party to the Berne Convention for the Protection of Literary and Artistic Works. It abolished the mandatory requirement of copyright notice for protection. It established a two-tier system in which registration is a prerequisite for infringement action for domestic works, but Berne countries other than the U.S. are exempt. It also doubled the maximum allowable statutory damages.
