Overview[]
The Bayh-Doyle Act provides, in part, for contractors to obtain title to a patent derived from research and development performed under federal funding if they are small businesses, universities, or not-for-profit institutions. Certain rights are reserved for the government and these organizations are required to commercialize the patent within a predetermined and agreed-on time.
