Definition[]

At common law, assault is the tort of intentionally and voluntarily causing someone to experience reasonable apprehension of an immediate harmful or offensive contact.

Overview[]

Because assault requires intent, it is considered an intentional tort, as opposed to a tort of negligence. The ability to carry out the apprehended contact is not necessary. Assault can also be a crime.
