Anti-Counterfeiting Amendments Act of 2004, codified at 18 U.S.C. § 2318.

Overview[]

The Act criminalized the knowing trafficking of counterfeit or illicit labels affixed to, enclosing, or accompanying a copy of a a variety of copyrightable works, including computer program. The statute also provided a civil remedy for copyright owners injured by violations.

A civil claim under the Act for counterfeiting requires proof of ownership of the copyrights for the works at issue and that the defendant knowingly trafficked in illicit or counterfeit labels that were affixed to, enclosed, or accompanied, or were designed to be affixed to, enclosed, or accompany the works.
