Overview[]
This project provides an EU‑wide comparative analysis of the remedies available as a means of ensuring individuals' rights in the area of data protection. It focuses on the juncture of two fundamental rights safeguarded by the Charter of Fundamental Rights of the European Union: the right to the protection of personal data (Article 8) and the right to an effective remedy (Article 47).
Since the right to an effective remedy is a prerequisite for the effective enforcement and implementation of all other fundamental rights, including data protection, it is important to look at both fundamental rights together.
