his Report summarizes its guidance in recent unfair labor practice cases involving employer responses to employees' use of social media. The report is intended to provide guidance on the lawfulness of employer social media policies under the National Labor Relations Act (NLRA).
These cases concern the protected and/or concerted nature of employees' social media postings and the lawfulness of employers' social media policies and rules.
